NextGen AgTech, LLC (“NextGen AgTech,” “we,” “us,” “our”) and our affiliated companies (“Affiliates”) respect your privacy and are committed to protecting your privacy through our compliance with this Privacy Policy. We are bound by the privacy laws of the countries in which we operate (“Applicable Privacy Laws”). We will process personal information in accordance with the Applicable Privacy Laws. 

In this Privacy Policy, “personal information” means information relating to an identified or identifiable natural person and personal data, personally identifiable information, and personal information as defined under Applicable Privacy Laws.

1. About This Privacy Policy 

This Privacy Policy describes how we use or process any personal information that you may provide us when you access and use our website and our cloud-based, software-as-a-service product and service offerings and their applicable user manuals, guides, and other documentation (collectively, “Platform”), including the NextGen AgTech family of products, available via https://www.nextgenagtech.com. We may modify or update this Privacy Policy from time to time by publishing the updated notice on our Platform or website. We encourage you to check our Platform and website periodically to ensure you are aware of our current Privacy Policy. However, if required by law, we will notify you of changes to our privacy practices using communications channels via our services.  

The Platform is designed to allow our clients, which may include copier/printer/MFP manufacturers, resellers, dealers, and similar service providers, to provide software tools for managed print services to their customers. “You,” as used in this Privacy Policy, refers to our clients, their customers, and any authorized users of our clients or their customers. In some instances, your information may be submitted through an alternative exchange with one of our clients, which may be your company or service provider. For example, if you are a customer of one of our clients, your information may be provided to us via your relationship with our client.

2. The Purposes for Which Personal Information Is Collected 

We may collect and process your personal information for the purposes of: 

  • Communicating with you about our products and services, which may include marketing information related to our products and services. 
  • Providing you with the products or services you request. 
  • Responding to your questions and comments and providing support. 
  • Allowing you to use the Platform’s interactive features, including its mapping, reporting, data analysis, and print management systems, and related services that you may permit to interact with your networks or devices (collectively, “Interactive Services”).

  • Operating, evaluating, and improving the products and services we offer. 
  • Understanding how our Platform is used so that we can improve our Platform.

  • User information. This is information that is captured when you access and use the Platform, including requesting or creating access credentials or participating in the Interactive Services. The data that we capture includes name and email address and any other information that you submit to, transmit through, or process on or through the Platform. User information may include financial information if you choose to purchase our products and services. User information may also include the physical address and/or floor maps of the locations where clients use our services or where our client’s customers operate their businesses and printer networks. 
  • Technical information. This is information we collect when you interact with our Platform. Technical information refers to information about your computer or other internet-connected device and your visits to the Platform, such as your IP address, geographical location, browser type, referral source, length of visit, and pages viewed. It may also include information about the hardware devices you use and other electronic addresses, network data, or environment data. 

3. Collecting Your Personal Information

Information You Provide to Us 

When you visit and use our Platform, we collect information you provide to us as follows: 

  • If you contact us to ask us for a particular product or service, you will need to provide us with certain information, including your name and email address, and you may choose to provide us with other information, including your phone number, credit card number, bank account, or other financial information so that we can respond to your request. 
  • The Platform is designed to provide software tools for managed print services. You may provide information related to your business and users, which may include your employees, agents, contractors, or your customers or clients, if you choose to submit such information to the Platform or otherwise allow the Platform to access, process, transmit, or store such information, through the Platform’s Interactive Services or otherwise. You are responsible for obtaining the appropriate consents, authorizations, permissions, or other rights necessary in order to provide us with personal information about another person. 
  • If you submit your details to receive emails from us and/or our newsletter, you will need to provide us with certain personal information, including your name and email address, so we can send you the emails and/or newsletters. 
  • If you submit your details to download one of our white papers, or equivalent content, via an online web form, you will need to provide us with certain personal information, including your name, email address, country, and company, so we can send you the white paper or equivalent content. 
  • When you contact us, as described above, you may need to disclose your personal information to us so that we can communicate with you. 

Information We Receive from Third Parties 

From time to time, we may receive personal information about you from third-party sources, such as publicly available social media sites. The types of information we may receive from third parties include your name and contact details, and we may use the information we receive from third parties for purposes such as contacting you about our products and services (in accordance with Applicable Privacy Laws). 

Information We Collect Automatically 

When you visit and use our Platform, we may collect certain information automatically from your device used to access our services. In some countries, including countries in the EEA, some of this information may be considered personal information. 

The information we collect includes information about your device hardware and software. This information may include your IP address, browser type, domain names, and internet service provider (ISP).

This information is used by NextGen AgTech to provide general statistics regarding the use of our Platform. We use this information to help us understand how our Platform is used so that we can improve our Platform and prevent and detect misuse of our Platform.

4. How Personal Information Is Retained 

We will store your personal information in our electronic records or in those of our third-party service providers or contractors. All information you provide to us is stored on our servers or the servers of our third-party service providers or contractors. 

When the purpose for which we have obtained your personal information is fulfilled, we delete or anonymize your personal information or, if that is not possible (for example, because your personal information is stored in backup archives for disaster recovery purposes), we securely store your personal information and isolate it from further use or processing. 

We retain data collected through our Platform for as long as necessary in order to provide you with the products and services that you purchase or otherwise request from us. We may retain your data after your use of our products and services end for up to one year or longer if we must do so in order to comply with or exercise our rights under applicable laws, including Applicable Privacy Laws.

  • Our Affiliates and other members of the NextGen AgTech group of companies.

  • Any law enforcement or regulatory body, government agency, court, or other third party where we believe disclosure is necessary as a matter of law to exercise, establish, or defend our legal rights or protect your vital interests or those of any other person.

Cross Border Transfer of Your Personal Information 

We use third-party service providers, many of whom process your personal information on servers located in the EEA and/or the United States of America, but your personal information may occasionally be stored in other countries. We may use one or more third-party service providers to perform the same or similar services for us in the future. 

Where your personal information is transferred within our Affiliates and between these third-party service providers, we take appropriate safeguards to require that your personal information will remain protected in accordance with this Privacy Policy and Applicable Privacy Laws.

NextGen AgTech exercises commercially reasonable efforts to have and maintain appropriate security measures to protect your personal information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please note, however, that no electronic transmission of information can be entirely secure, and although reasonable care is taken, we cannot guarantee the security of information transmitted via electronic means. Any transmission is at your own risk. 

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a username and password for access to certain parts of this Platform, you are responsible for keeping this information confidential. 8. Your Data Protection Rights 

 Depending on where you are located and the Applicable Privacy Laws that apply to our use or processing of your personal information, you may have one or more of the following rights: 

  • You may request to update or correct your information. 
  • You may request access to your personal information to know what sort of personal information is held about you, for what purposes, and how it is collected, held, used, and disclosed. In some circumstances, we may refuse to provide copies if an exemption under Applicable Privacy Laws applies. For example, we may not provide access to personal information if disclosing that information would impact the privacy of another individual (having assessed the impact to the privacy rights and freedoms of the other individual). Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information if we are able to do so without your consent.

You may exercise your data subject rights free of charge by contacting us. However, in some instances, we may be unable to comply with your request if Applicable Privacy Law prohibits us from doing so, and in some instances, we may charge you a fee to comply with your requests if they are manifestly unfounded or excessive. When you exercise your data subject rights, we may need to take measures to verify your identity before complying with such exercise. We will respond to your requests in connection with your data subject rights in accordance with any timeframes set out in Applicable Privacy Laws.
